These “Digicel Shake to Win Regional Draw Promotion” Terms and Conditions (the “Terms and Conditions”) apply to you and govern your participation in the “Digicel Shake to Win Regional Draw Promotion” (the “Promotion”). You should read these Terms and Conditions carefully before participating in the Promotion.

In these Terms and Conditions, “we”, “our” or “us” means Digicel Caribbean Limited, a company registered under the laws of St. Lucia with the registered offices at 20 Micoud Street, Castries, Saint Lucia and its subsidiaries and affiliates (“Affiliates”). References to “I”, “you” or “your” means the person participating in the Promotion.

By participating in the Promotion, you agree to be bound by these Terms and Conditions. These Terms and Conditions incorporate the MyDigicel Terms and Conditions and Privacy Policy which you can access via the MyDigicel Mobile Application (“MyDigicel App”). If you do not agree to or accept any of these Terms and Conditions, you should not participate in the Promotion.


1.       What is the “Digicel Shake to Win Regional Draw Promotion”?

Digicel is offering its prepaid and postpaid customers the opportunity to participate in the Promotion which is a weekly multi-jurisdictional promotion. The Promotion provides the chance to WIN a weekly prize of Five Thousand United States Dollars (USD $5,000.00) (“the Prize”). Any tax liability arising from the receipt of the prize will be the responsibility of the recipient.

The Promotion allows you to WIN prizes by shaking your phone via the ‘Shake It’ gaming mechanism in the MyDigicel app. Every participating customer will have a chance to win by using Shake It in the MyDigicel App on a Saturday, with a prize draw taking place every Monday.

2.       What is the promotional period for the Promotion?

The Promotion is valid from Friday, March 21, 2020 through to Saturday August 15th, 2020 local time in each Participating Market (the “Promotional Period”).  Digicel reserves the right to change the Promotional Period at any time with the approval of the Betting, Gaming and Lotteries Commission and will notify of same on the Digicel website.

3.       Who is eligible to enter the Promotion, (“Eligible Customers”)?

In order to be eligible for the Promotion, you must be a Digicel customer with an active Eligible Plan (as defined in Clause 4) in a Participating Market and have shaken your phone via the Shake It mechanism in the MyDigicel App on a Saturday during the Promotional Period. This includes customers who activate a new Eligible Plan during the Promotional Period.

The following customers are excluded from participating in the Promotion:

a.     Postpaid Corporate & Business account customers;

b.     Employees/family members of employees (e.g Spouse, Mother, Father , Sister , Brother, Daughter, Son etc) and employees of Affiliates and companies associated with this promotion;

c.     Home & Entertainment only customers;

d.     Postpaid customers with overdue amounts;

e.     Persons under the age of 18 years.


4.       Which Digicel prepaid/postpaid bundles/plans are included in the Promotion?

No. The Participating Markets for the Promotion are:

6.       How does a customer participate in the Promotion?

                    i.        To participate in the Promotion you will need to have activated an Eligible Plan via one of the following channels:

1.     MyDigicel App; or

2.     USSD/UMM (by dialing *147#).

                   ii.        Eligible Customers will receive a ‘Shake It’ notification inviting them to participate in the Promotion. The notification will be received either via SMS push and/or an In the MyDigicel App notification.

                  iii.        By clicking on the ‘Shake It’ notification, and accepting the terms and conditions, the customer has confirmed their participation in the Promotion. (“Participating Customer”);

                  iv.        Once an Eligible Customer agrees to participate in the Promotion, they can then Shake To Win!

                   v.        Please note the ‘Shake It’ action must be completed in the MyDigicel App.

                  vi.        Participating Customers will only have one (1) chance to win each weekly Prize during the Promotional Period.

                 vii.        This Promotion will be accessible to Participating Customers while roaming, but any prizes won will only be available to be redeemed in Jamaica.

7.       Will customers be notified when to participate in the Promotion?

Yes.  Whenever a Customer activates an Eligible Plan, they will receive an SMS/MyDigicel App notification that they are eligible for a Chance to Win.

8.       How will the winner be selected?

The Prize Draw Process:

a.     A customer will be selected at random from the complete listing of Eligible Customers received from all participating markets during the promotion period (“the Selected Customer”).

b.     There will be one (1) winner per Draw per week.

c.     Selection will take place at the Digicel Caribbean Limited’s Head Office in St. Lucia as per the draw dates listed below:

9.       How will winners be notified?

a.     The Selected Customer will be notified by a Digicel Representative calling the mobile phone number used by the Selected Customer to participate in the Promotion.

b.     If the prize is declined or unclaimed as the Selected Customer cannot be contacted from the details supplied on their submission after three (3) phone call attempts (over a twenty-four (24) hour period) or if the Selected Customer does not present per Clause 10, Digicel reserves the right to re-draw and award the Prize to another Eligible Customer at random with consultation and approval of the Betting, Gaming and Lotteries Commission otherwise Digicel will retain the prize

c.     The prize is non-transferable and Digicel reserves the right at any time to cancel, modify, or supersede the Promotion due to circumstances outside its control with consultation and approval from the Betting, Gaming and Lotteries Commission.

d.       Digicel’s decision is final and binding on all participants with consultation and approval from the Betting, Gaming and Lotteries Commission.

10.   What will the selected customer need in order to claim the Prize?

During the telephone contact of the Selected Customer, full details of the prize handover (redemption) process and location will be confirmed.  The customer will need to present a valid Government issued photo ID (passport, voters’ identification card or driver’s licence) and have the phone used to participate in the Promotion.  The customer will be required to complete and sign a Redemption Form confirming their receipt of their prize and/or a Consent Release Form authorizing the use of their name and picture for marketing purposes as per the additional Terms and Conditions.

In the event that a special needs customer is selected and they are unable to collect their prize, that customer will be allowed to have a representative collect the prize on their behalf who must provide a written authorization from the winner endorsed by a Justice of the Peace or Notary Public and valid Government issued photo identification for both the winner and the representative to claim the prize.

The customer shall have fourteen (14) days after the initial notification to receive the prize.

Additional Terms and Conditions

A.    This Promotion is offered for your personal use and not for commercial use.

B.     We reserve the right to disqualify you or terminate this offer if, in our opinion, the Promotion is being abused with consultation and approval of the Betting, Gaming and Lotteries Commission.

C.    You are solely responsible for all associated fees and costs incurred by you for redemption of the prize, including but not limited to Withholding Tax or any other ‘winning’ tax.

D.    The selected winner must have complied with these Terms and Conditions to enter and be on an active, qualifying contract with no accounts held with Digicel being in arrears to be eligible to win the prize.

E.     We reserve the right to modify or discontinue (permanently or temporarily), this Promotion being offered to you with consultation and approval from the Betting, Gaming and Lotteries Commission.

F.     We reserve the right to, at any time, with or without notice, vary or cancel these Terms and Conditions of this Promotion with consultation and approval of the Betting, Gaming and Lotteries Commission. In the event we give notice to you of any such changes to or cancellation of the Promotion, it shall suffice for us to give you notice via messages to your handset/device or to post such notification on the Digicel website or the MyDigicel App. Any such notification shall be effective immediately or as of the date referred to in such notifications.

G.   Any personal data relating to participants will be used solely for the purposes of this promotion by Digicel and/or by any agent appointed by it to assist with running the promotion on behalf of Digicel and will not be disclosed to a third party for any other purpose without the individual’s prior consent. By entering this Promotion, you consent to the use of your personal data by Digicel and/or any agent appointed by Digicel to assist with running the promotion for the purposes of administration of the promotion (including publishing your full name and county and/or disclosing it to third parties on request if you are the winner) and any other purposes to which you have consented. H.      All entrants agree to take part in any promotional, marketing or publicity activities or events reasonably requested by Digicel.  By participating in the Promotion, entrants consent to the use of their name, likeness, image, photograph for any and all programming and/or publicity or advertising purposes, commercial or otherwise, in all media and formats used by Digicel’s or its agencies, without further compensation, throughout the entire world in perpetuity. If a winner refuses to do so, they forfeit their right to claim the prize. 

I.      In addition to these Terms and Conditions, you remain bound by our My Digicel App Terms and Conditions of Use.

K.     This promotion is authorized under section 58 (3) of the Betting, Gaming and Lotteries Act.
